COLLECTION AND PROCESSING OF PERSONAL DATA
Smart Commute B.V. processes your personal data because you are or have been making use of our services and / or because you have provided this data to us. Below you will find an overview of the personal data we process:
If you use our services as a customer and are therefore registered and / or if you use our app, we will process the following personal data about you:
- First and last name
- Address data
- E-mail address
- Payment details including bank account number
- Other personal data that you actively provide, for example by creating a profile on this website, in correspondence and by telephone
- Information about your activities on our website
- Internet browser, IP address and device type
If you are not a customer with us, you have not registered and have not activated our app, we will not collect and process personal data from you, only encrypted anonymized (location) information.

Brekr app, for which your data is used
The data is primarily used for:
- The functionalities of the app, such as Track and Trace, the data, distance, speeds and routes of rides made with the moped
- Sending notifications on request, for example if the moped is moved faster than 50 km per hour, reporting your moped stolen or for charging your battery, necessary maintenance and unexpected defects
- Being able to view and share personal preferences with others on your initiative
- Your data will also be used to improve products and services and to develop new products and services by Smart Commute B.V. / Brekr and the companies associated with Brekr.
Data is personalized by linking to your moped and your Brekr account. For the improvement and development of products and services, data from multiple users of the app and possibly other data from those users, is processed in analyzes. The results of this can not be traced back to individual users.
Your data will not be traded or otherwise provided for commercial use by third parties outside of the companies associated with Brekr. Your data will also not be used for advertising purposes and making offers outside the app. Advertisements, offers and information about products are only shown in the app after you have given your consent. You can always withdraw that permission.
App, the data used
The sensor in your connected Brekr transmits the following data to the app: unique product number of the moped and any parts, location of the moped, routes and distances traveled by the moped, status information about parts or necessary maintenance, speed.
In addition, the following data from your Brekr account is used: your personal data such as name, address, city and contact information such as e-mail address and telephone number.
The app uses the following data from the device on which the app is installed: unique device number, device type, location data. The location data of the device is used to display the location of the phone in relation to your moped. That location is not stored on our systems. When you log in with your Facebook or Google+ account, the following data is used: your name and the token on which the identification and authorization is based. Naturally, the data entered by you in the app will also be processed.
App, storage and retention periods
In addition to storage on the device on which the app is installed, your data is under the responsibility of Smart Commute B.V. / Brekr stored in a database. This database is located in the Netherlands and meets the legal security requirements. The data will be saved as long as you do not cancel your account. When removing the moped within the app, your account will be disconnected from the technical and location data of the moped. Your personal data from your Brekr account will remain in the system for future use. If you want to permanently delete your data, you can send an email to firstname.lastname@example.org.
Automated decision making
Smart Commute BV does not allow decisions based on automated processing to be made about matters that can have (significant) consequences for people.
How long we keep personal data
Smart Commute BV does not store your personal data longer than is strictly necessary to realize the purpose for which your data are collected.
Sharing of personal data with third parties
Smart Commute BV does not sell your data to third parties and will only do so if necessary for the implementation of our agreement with you or to comply with a legal obligation. We work together with companies that process your data on our behalf and enter into a processor agreement with them to ensure the same level of security and confidentiality of your data.
